Position: Civil Deputy

Status: Part-Time (Not to exceed 30 hrs/week or 129 hrs/month)

FLSA: Non-Exempt

Rate of Pay: $20.00 hour

Reports to: Civil Deputy Supervisor

Position Purpose :

The purpose of this position is to perform the execution of civil processes and mandates of the courts; performs all other related work as required.

Supervision:

Supervision Scope : Performs functions primarily based on clearly prescribed standard practice but frequently required to make decisions, which involve choice of action within limits defined, by standard practice and instructions.

Supervision Received : Works under the general direction of the Chief Deputy and in accordance with applicable Maine State Laws and relevant state, federal and local regulations and standards, referring all unusual cases to supervisor.

Job Environment:

Majority of work is performed outdoors, in an office or traveling in a vehicle. There is a moderate noise level. Regularly operates a vehicle, computer, telephones and other standard office equipment. Makes frequent contacts with the general public to include tenants, debtors, lawyers, landlords, property managers, etc. Contacts are primarily in person or by telephone. Some contacts may have to be done in writing. Candidate must be willing to work a flexible schedule on a regular basis in order to accommodate the public requests. Has access to department-related confidential information such as highly sensitive personal information about citizens; the application of appropriate judgment, discretion and professional office protocols is required. Errors could cause confusion and delay, and could cause legal ramifications.

Essential Functions:

– Serves orders of civil court; delivers court orders such as subpoenas, garnishments, property executions to individuals.

– Confiscates real or personal property by court order for disposal at Sheriff’s sale and posts notice of sale in public locations.

– Assists individuals by explaining what paperwork is required and the locations of the courthouses in which to file the paperwork.

– Serves income and property executions and records and mails copies of such notices.

– Serves eviction notices and contacts attorneys to finalize evictions.

– Communicates, coordinates and facilitates with plaintiffs regarding all process assigned to them.

– Records delivery of civil documents and returned proof of service.

– Enters and maintains data and records into specialized files; completes necessary reports.

– Contributes to team effort by accomplishing results as needed.

– Maintains professional and technical knowledge by attending educational workshops, establishing personal networks and participating in professional societies.

– Supports the county’s safety and health policies by attending required safety training programs and reporting all accidents and suspected safety hazards to supervisor.

– Performs similar or related work as required.

Recommended Minimum Qualifications:

– High School Diploma or equivalent; basic computer skills;

– Two (2) to three (3) years experience in law or civil practice or related field.

– Preference will be given to post-secondary education. Preference given to previous law enforcement officer with emphasis on civil matters; associates degree in criminal justice and or training in real estate law and landlord/tenant law.

– Possession of a valid Maine driver’s license with a clean driving record.

Strongly preferred Maine Criminal Justice Academy 100 hour course or Basic Law Enforcement pre-service course.

Knowledge, Ability and Skill:

Knowledge : Working knowledge of the statutes, local laws, law enforcement rules and regulations, and the court system; Knowledge of civil and criminal law and rules of court; Thorough knowledge of the court system and procedures; Knowledge of unarmed self-defense.

Ability : Ability to make sound judgments under stressful situations; Ability to communicate clearly and concisely; Ability to analyze and interpret laws, ordinances, rules, regulations, standards and procedures and to apply them to specific situations and cases; Ability to work without direct supervision.

Skill : This position requires good time management skills; Court issued paperwork is time sensitive and need to be served in a timely manner; Good problem solving skills is required along with proficient computer skills.

Transportation Requirement:

The York County Sheriff’s Office will provide a vehicle for which the civil deputy assigned to this position will use. The vehicles gas and maintenance will be the responsibility of the Sheriff’s office.

Physical agility is required to access all types of areas. Regularly required to walk, talk, run, stand, jump, climb, stoop, crouch, kneel and climb a ladder/fence/stairs; must be able to access all levels of a building/structure. Ability to operate office equipment and operate and view computer screens. Eyesight, including corrected eyesight, with regards to close vision, distance vision, color vision and depth perception is required to perform the job.
